At different times in our lives, we all need to make decisions. We make important decisions about our finances, property, employment, accommodation, healthcare, and social supports.

There are five different decision support arrangements for people who have challenges with their capacity and who may need support to make certain decisions. These arrangements are based on the different levels of support that a person requires to make a specific decision at a specific time.

If you are planning ahead, you can make and register an enduring power of attorney.  This arrangement gives authority to a person you know and trust, to act on your behalf if you lose the capacity to make certain decisions in the future. This person is called your ‘attorney’ but does not need to be a lawyer. These decisions can be about your personal welfare and property and financial matters. You can give your attorney the general authority to act on your behalf about all or part of your property and affairs and personal welfare. Alternatively, you can give your attorney the authority to do specific things on your behalf. You can have more than one attorney and you can choose a replacement attorney in case one of your attorneys is unable to continue in the role.

ENDURING POWER OF ATTORNEY

Preparing an Enduring Power of Attorney allows you to prepare for the possibility that you may lose capacity to manage your affairs in the future, due to an illness or an accident. It allows you to appoint Attorneys that can act for you in circumstances where you cannot act for yourself. You may wish to prepare such a document to allow your Attorneys to have the power to manage your finances, sell your house for the purposes of moving to a nursing home or make day to day decisions on your behalf.
